You Need to Know:

With a well-designed estate plan you can be assured:

  • Your family's welfare is provided for.

  • Estate taxes can be avoided or reduced.

  • Your assets will go to your intended beneficiaries.

In probate:

Probate is the procedure for distributing a person's possessions after death.

In Colorado, probate is required for estates over $50,000 or those that include real estate.

Most estates in Colorado are administered in 7 to 12 months.

Estate Planning and Probate

Often, people don't want to think about the details of estate planning. But the fact is, you talk with your estate planning attorney about matters near to your heart. Together, we answer important questions-like how to provide for minor children or how to avoid or reduce taxes. As a result, you gain the peace of mind that comes from knowing your assets will benefit the people or institutions you choose.

At Stevens, Littman, Biddison, Tharp & Weinberg, in Vail and Boulder, Colorado, estate planning attorneys serve people from a variety of circumstances. Our goal is to create a plan that achieves your wishes and can be settled simply and efficiently while minimizing costs and taxes.

We use a variety of devices to direct your asset disbursement including (but not limited to) a simple or complex will, a number of trust options, insurance policies, family partnerships, conservatorships, and guardianships. Some of our primary goals in estate planning are:

  • Assuring you keep enough of your assets accessible to provide for your needs
  • Ensuring your assets go to the people you have chosen
  • Providing guardianship for minors or mentally disabled adults
  • Preserving funds inherited by minor children and providing for their support, education or other needs
  • Avoiding or minimizing estate, generation skipping, and income taxes
  • Providing simplicity in the administration of an estate or trust
  • Planning for special needs adults or minors and non-traditional family units
  • Providing for charitable tax savings and gifts of conservation easements

Probate

Probate is the process by which the will is filed with the Probate Court and administered. There are some areas that can be difficult, and if not done correctly can add to the cost and time required.

At Stevens, Littman, Biddison, Tharp & Weinberg, our Colorado probate lawyers work with you to provide the help you need, whether it is fully handling probate, or administering only a portion. Our goal is to enable a process that is smooth and efficient.
